Terms of purchase

Brittfurn's e-shop and store offer elegant, classic furniture, beautiful interiors and renowned brands from England and the rest of the world. We are constantly searching for the best brands and collections, with an emphasis on international interiors and design. We want you as a customer to feel that shopping through our e-shop “www.p1o5i9u3y7.shop” (hereinafter “the website”) and our physical store is convenient and secure. We therefore apply the terms of purchase and delivery stipulated below (hereinafter “the terms”) to all orders placed in accordance with point 1.

Overview


These terms apply to all orders and purchases made through the website or the physical store by a consumer or a trader, where delivery takes place to a member state of the European Union. A consumer means a natural person acting for purposes which are primarily outside the scope of a business activity. Where this agreement conflicts with the Swedish Consumer Purchases Act (konsumentköplagen, 1990:932) or the Swedish Act on Distance Contracts and Off-Premises Contracts (lag (2005:59) om distansavtal och avtal utanför affärslokaler), those acts shall apply instead where the agreement is with a consumer. For agreements with traders, the Swedish Sale of Goods Act (köplagen, 1990:931) applies to supplement any matters not regulated in this agreement.


2.1 Value added tax
All prices on the website are stated in Swedish kronor and include VAT at 25%. VAT is charged on all orders where delivery takes place to a member state of the European Union.

2.2 Shipping
All prices on the website are stated exclusive of shipping. We deliver all wallpapers and lamps over 500 SEK and fabrics over 2500 SEK free of charge to Sweden, Denmark or Finland. For purchases under 500 SEK with delivery to the countries mentioned above, or, regardless of price, for purchases with delivery to any country other than those mentioned above, a shipping charge applies. The shipping cost is stated at the time of ordering.

The shipping costs mentioned above apply only to wallpapers, fabrics and lighting. For furniture, a delivery charge applies, which normally costs 4 000 kr for delivery to the property boundary by courier. Should the customer wish to add a carry-in service, an additional charge applies, which is calculated at the time of purchase.

2.3 Wallpaper and fabric samples
Ordering wallpaper and fabric samples costs 50 Swedish kronor. Samples are sent by ordinary post and therefore cannot be tracked. This means that Brittfurn has no control over their delivery once the sample has been sent. Normal delivery time is 1 to 3 weeks. If the wallpaper sample has not arrived after 3 weeks, please contact Brittfurn to have a new one sent out.

2.4 Discount codes and gift cards
If you wish to use a discount code or a gift card, you must enter it when placing your order. A discount code or gift card that has not been entered cannot be redeemed after the order has been completed.


Your order placed through the website is not binding on Brittfurn upon your receipt of an order confirmation. This is because a large part of our range consists of made-to-order goods. These goods may have been taken out of production or, for some other reason, be impossible for us to deliver. Brittfurn therefore reserves the right to cancel the order within one week from the time the order confirmation was received. This only happens in exceptional cases, and Brittfurn always strives to inform the customer as soon as we become aware of this.

Price changes and obviously incorrectly priced goods
We reserve the right to change prices in circumstances beyond our control (for example currency fluctuations, increased purchase or manufacturing prices or increased VAT). In addition, we reserve the right to cancel orders where the goods are obviously incorrectly priced.


Colours and patterns are perceived differently by different people. This means that the product texts describing our goods are intended to give you a feel for, rather than a complete and exhaustive description of, the nature of a product. It is not unusual, for example, for a wallpaper colour to appear different on a computer screen than it does in physical form. We can never guarantee that the wallpaper or fabric will be exactly the same colour as the customer's existing wallpaper, wallpaper sample or the wallpaper book in our showroom. This is because wallpapers and fabrics are manufactured in different batches. If the customer wants exactly the same colour range as a previous order, we must have the batch number that accompanies each roll of wallpaper. For the reasons stated above, we strongly recommend that you order individual wallpaper or fabric samples before making your full purchase. Wallpapers and fabrics are made-to-order goods and are not covered by the right of withdrawal (see point 10). Ordering wallpaper or fabric samples costs 50 Swedish kronor. Samples are usually A4 or a slightly smaller format.

As many of our goods, for example furniture, are manufactured to order or according to the buyer's wishes, these goods may differ in colour shade from one piece to another. This is something the seller cannot influence, as all of Brittfurn's furniture is made by hand and with materials whose properties may vary from piece to piece. Our ambition is to accommodate the buyer's wishes as far as possible.


We offer three different payment methods via the website:

Klarna Checkout
Payment via Klarna Checkout. Klarna Checkout offers various solutions for your payment. You can pay by invoice, either the full amount or in instalments. If you have an account with Klarna, you can collect several purchases and pay for them all at once. You can also pay by bank transfer or by card. Please note that business customers cannot pay via Klarna Checkout.

Payment by invoice
If you wish to pay by invoice, please email us at info@p1o5i9u3y7.shop with details of what you wish to purchase and your invoicing details. Please note that the order is sent to the factory once Brittfurn has received payment into its account.

Payment by debit or credit card (VISA and Mastercard)
The card number and the card's expiry date must be provided. The money is debited from the card at the time of ordering. Please check that there is no block on internet payments on the card. For card payments we use Shopify Payments as our partner. Shopify Payments verifies the credit card online quickly and securely. The card number is sent via an encrypted connection directly to the bank. We have no access to any card details or bank account details. If the payment is approved by the bank, the money is transferred from your account to our account.

Orders and purchases in the physical store
For orders and purchases made in person in the physical store, payment is offered by debit or credit card or by invoice. Please note that the order is sent to the factory once Brittfurn has received payment.

Deposit
When ordering products with a normal delivery time of 12 weeks or longer, the customer is offered the option of first paying a deposit of 30 % of the total amount in order for the order to be sent to the factory, instead of paying the full amount at the time of ordering. Final payment of the remaining 70 % of the total amount is then made upon collection or delivery of the goods. The deposit is not refunded to the buyer should the buyer cancel the purchase.


Delivery time
Delivery method, terms and delivery time vary depending on the type of goods and the country. For example, a specially ordered item may take longer to deliver than one that is in stock at the time of ordering. The normal delivery time for wallpapers depends, among other things, on which supplier manufactures it, which country it is shipped from and stock status. The normal delivery time for each individual wallpaper is specified on the website in the description of the wallpaper.

For furniture, the normal delivery time is 12 weeks. Our delivery times may, however, be affected by factors beyond our control, such as delays from third parties. One example of what can happen is when we sell upholstered furniture where the fabric is ordered from the fabric supplier, who in turn sends the fabric directly to the furniture factory. Once the fabric is received by the furniture manufacturer, it is carefully inspected by the factory. If there is a fault with the fabric, new fabric is ordered/sent from the fabric supplier. Another scenario that may arise is that the fabric is out of stock at the fabric supplier. In addition to this, there may be other scenarios that arise which are beyond our control. These delivery times are therefore only an estimate and may differ from order to order.

Delays in delivery
In the event that delivery of the goods is delayed beyond what has been agreed or beyond what can reasonably be assumed to constitute normal delivery time, we strive to inform the customer of this in good time. Should delivery nevertheless be delayed, please contact us as soon as possible. That way we can quickly and easily investigate the cause of the delay. We use Postnord Logistics when shipping wallpapers and fabrics. All other deliveries are made by individual transport companies depending on the product. Delays may occur in their delivery times. Brittfurn is not responsible for the delivery time once the parcel has been handed over to the transport company. We are happy to help our customers find out the reason for any delay.

Delivery methods (within Sweden)
• Dispatch by post or courier.
• Collect from our store. Goods can be collected from our showroom at Sturegatan 20 in Stockholm at no extra cost. We will contact you when the product is ready for collection.

Transport damage
We use carefully selected carriers of good quality. However, transport damage can always occur. As the buyer, you are obliged to examine the goods carefully upon delivery, or in close connection with delivery. If you discover that the goods are damaged in any way, you must contact the carrier or our customer service (see point 11 for contact details). Transport damage is the responsibility of the carrier, not Brittfurn. Brittfurn's responsibility for the goods ceases when they leave the store with the transport company. Nevertheless, we will of course always do our best to help you in your contact with the carrier.


If you consider that the goods are in any way defective, you should make a complaint in accordance with point 8. If the goods are defective and you have made your complaint in time, we will ensure that the defect is remedied or that the goods are replaced. If you wish to claim that goods are defective, it is important from an evidentiary point of view that you have the order confirmation. Please therefore make sure you keep it.


Complaints regarding defective goods or delays in delivery must be made within a reasonable time. Our contact details can be found under point 11. For wallpapers and fabrics, no complaint can be made if the goods have been used. Please make sure to examine the wallpaper/fabric before use. Brittfurn does not replace rolls of wallpaper that have been hung or fabrics that have been sewn.


We are not responsible for parcels that are not collected within a reasonable time. Nor are we responsible for uncollected parcels that are returned to us. Uncollected parcels returned to us are shipped at your risk, and you bear the shipping cost. It is therefore important that you collect a parcel even if you have cancelled your purchase. If you as a customer have failed to collect the parcel but still want the goods, you pay the shipping cost for the second dispatch yourself.


Withdrawal period and notice
Our aim is for you to be satisfied with purchases made through the website. If, however, this is not the case, under the Swedish Act on Distance Contracts and Off-Premises Contracts (2005:59) you have the right to withdraw from and return your purchase within 14 days of the goods coming into your possession (right of withdrawal and withdrawal period). If you wish to exercise your right of withdrawal, you must notify us in accordance with point 11. You can return the goods by post or to us in the store (see the return address in point 11). You bear the shipping cost of the goods if you wish to return them by post. In addition, you may be liable for any diminished value of the goods resulting from your having handled the goods to a greater extent than was necessary to establish their nature or function. If you return goods, the packaging must be unbroken and in undamaged condition, with any labels still attached.

Exceptions
The right of withdrawal does not apply if the goods have been manufactured according to your instructions or if, as a result of your order, the goods have otherwise been given a clearly personal character, for example made-to-measure furniture or lighting. The right of withdrawal does NOT cover wallpapers and fabrics. This is because all wallpapers and fabrics are printed and cut to order. These products are therefore unique in terms of dye batch and dimensions with each production run. Please note that colour differences between different production runs do not entitle you to a return. We therefore always recommend ordering cuttings before placing an order.

The Swedish Act on Distance Contracts and Off-Premises Contracts (2005:59) contains a number of provisions that limit the right to exercise the right of withdrawal. Under Chapter 2, Section 11, point 3 of the Swedish Act on Distance Contracts and Off-Premises Contracts (2005:59), the right of withdrawal does not apply if the agreement concerns goods that are manufactured according to the consumer's instructions. At Brittfurn, this applies to wallpapers, fabrics, lighting, wooden and upholstered furniture, which are made-to-order goods and are manufactured according to the customer's individual wishes once the order has been placed. The images and descriptions on the website are therefore, in this case, a showroom for what can be manufactured. When the customer orders an item, production begins according to the instructions the customer provides through the order. The item is manufactured individually for the customer, and Brittfurn has no possibility of taking back and reselling the item. For this reason, Brittfurn cannot offer any right of withdrawal in these cases.

The right of withdrawal does not apply to goods purchased as seen in the physical store, for example display items.

The right of withdrawal does not apply to traders.

Refunds
If you withdraw from your purchase and return the goods in accordance with point 10, we will refund what you paid for the goods without undue delay, and no later than 14 days from when we received your notice that you have withdrawn from your purchase.

We are released from fulfilling the obligations set out in this agreement if fulfilment of the obligations is prevented by circumstances beyond our control which we could not reasonably have foreseen at the time the agreement was concluded, where the circumstances materially affect our ability to fulfil the obligations. The same applies to the effects and consequences arising from the circumstances stated above, where these effects and consequences could not reasonably have been avoided. This includes, but is not limited to, government decisions, war, natural disasters, fire, accidents and industrial disputes.


For consumers
We always strive to ensure that our customers are satisfied with the goods and services we provide. It is therefore our principle to resolve any disagreements in the first instance by agreeing on a solution that benefits both parties. If, despite our efforts, we are unable to do so, you should turn to the Swedish National Board for Consumer Disputes (Allmänna Reklamationsnämnden, ARN) for an independent review, or to a Swedish court applying Swedish law. We follow ARN's recommendations.

It is therefore our principle to resolve any disagreements in the first instance by agreeing on a solution that benefits both parties. If, despite our efforts, we are unable to do so, the matter shall be decided by a Swedish court and in accordance with Swedish law.
